The assassination attempt in Butler, Pa. left a rallygoer and the gunman dead. The gunman’s motive is still a mystery; investigators said they believe he acted alone.

William C Hoyle, who was wanted for a shooting that left an innocent bystander in critical condition in Wildwood, New Jersey, has been taken into custody.

A spokesperson for DA Larry Krasner said the death penalty decision followed “extensive input” from both experts and Fitzgerald’s family.

The investigation — which is civil, not criminal — began under former New Jersey Attorney General Gurbir Grewal and has continued under his successor, Matthew J. Platkin.

The victims, between the ages of 16 and 46, were shot while standing outside Wednesday night. Police say one is in critical condition while the rest are stable at a hospital.

Police said no weapons were recovered at the scene and no arrests have been made.

A spokesperson with the Delaware Department of Justice says it is reviewing the ruling. Delaware banned bump stocks in 2018.
