U.S. judge denies challenge to Rehoboth scooter parking rule
A judge has rejected a lawsuit challenging Rehoboth Beach’s parking permit requirement for motor scooters.
A resident challenged the $40 permit requirement, saying it was unfair for the community to impose a fee for a permit for motor scooters and not for cars.
Rehoboth Beach had previously allowed scooter operators to park for free at sidewalk bike racks, but later determined that it was unsafe.
It now institutes a $40 seasonal parking pass for scooters in unmetered street spots.
The community argues that scooters can be driven onto sidewalks and are therefore different than cars, and that owners could avoid the fee by simply parking in a metered space and feeding the meter.
The News Journal of Wilmington reports that U.S. District Judge Richard Andrews dismissed the suit Thursday.
