Rape charge against former Montgomery County GOP chair dismissed

    A district judge has dismissed rape and sexual assault charges against a former Montgomery County GOP chairman Philadelphia accused of having sexually assaulted a female employee of his former law firm.

     

    Judge Joann Tey Real held aggravated assault and indecent assault charges against 66-year-old Robert Kerns for trial in Montgomery County Court.

    The state attorney general’s office refiled the rape and sexual assault charges after county prosecutors dismissed them, saying a drug test had been misinterpreted.

    Prosecutors have alleged that Kerns offered the woman a ride following an Oct. 25 work party and later “engaged in sexual acts without the victim’s consent or knowledge.”

    Defense attorney Brian McMonagle said Wednesday that his client was pleased with the ruling and the evidence didn’t support the charges.
