Florida court rules against Delaware AG Biden

A Florida appeals court has rejected Delaware Attorney General Beau Biden’s effort to reopen and intervene in a 2004 reorganization of the trust that funds the Nemours Foundation.

 

The court said in a 2-1 ruling Wednesday that Biden had failed to show that a trial court abused its discretion when it rebuffed his attempt last year.

The Nemours Foundation runs the Alfred I. duPont Hospital for Children in Wilmington and other health care facilities in Delaware, Florida, New Jersey and Pennsylvania. It also operates the Nemours Mansion and Gardens in Wilmington.

Biden says trustees of the $4 billion Alfred I. duPont trust have altered the governance structure of the foundation in a way that dilutes Delaware’s influence and shorts Delaware residents in distributions of trust proceeds.
