N.J. League of Municipalities falls under open records law
Fair Share Housing Center’s records request with the New Jersey State League of Municipalities is valid under the open record, according to the latest ruling by the state supreme court.
The league must turn over the studies, e-mail messages and letters the Cherry Hill-based company has requested as part of its dispute around towns’ housing responsibilities.
As the Star-Ledger reports, Fair Share Housing filed a suit when the League refused the company’s records request in 2008 involving the League’s “reasoning behind its opposition to a proposal by the state Council on Affordable Housing (COAH) for calculating municipalities’ obligations.”
The supreme court ruling overturns a previous decision that the League is not a public agency and therefore not subject to the open records law.
