N.J. court to rule on suit over polio vaccine

    New Jersey’s Supreme Court is scheduled to rule on whether a man’s lawsuit over a polio vaccine he received as a child can go forward.

    Jamie Gannon’s 2003 suit claims the vaccine he was given as baby in the mid-1970s caused a brain tumor.

    It names American Home Products Corporation, American Cyanamid Company and Lederle Laboratories. Gannon alleges the vaccine contained a simian virus that caused his cancer.

    The case initially was dismissed by a judge who said Gannon hadn’t proved the vaccine caused his cancer and couldn’t identify who manufactured it.

    An appeals court reversed that decision in 2010.
