Lawyer challenges “Live Stop” program on behalf of daughter
A Philadelphia Attorney is putting together a class-action lawsuit against the “live stop” program after his daughter got caught without a valid car registration.
The live-stop program is designed to catch drivers without registration or insurance to remove them from the roads. Attorney Stephen Sheller said his daughter was stopped a week ago in West Philadelphia for not having current registration. But he says police violated program rules by leaving her stranded as they towed her car away instead of just immobilizing it.
“It specifically distinguishes in this specific type of circumstance between impounding and immobilization,” said Sheller. “Immobilization means parking the car on the side of the street or a parking lot nearby or in a parking area nearby Where you can get your car registered on line as I did and my daughter should have been permitted to drive it away.”
Sheller said the law violates the right to due process. A spokesman for the police department says he cannot comment on the suit, but says police are obligated to transport drivers whose cars are impounded to a safe area.
