Fumo lawyers in court to discuss new sentencing date

Update 11:55 a.m. Fumo will be resentenced Nov. 9.

Original report Vince Fumo’s term will be discussed in court today, but it’s about jail time, not an election term.

The former senator’s lawyers will be in court to discuss a new sentencing hearing date for his 2009 fraud conviction. In August, a federal appeals court tossed out the four-and-a-half year sentence Fumo was given. Prosecutors argued the sentence was too light.

The appeal was the apparent result of U.S. District Judge Ronald Buckwalter not weighing heavily enough Fumo’s $1.5 million in damages.

Fumo, still jailed in Kentucky, wants a new trial. WHYY/NewsWorks’ Dave Davies will be in court today to let us know what happens.
