AP: MontCo sues Pa. family over school district discrepancy
Philadelphia couple whose daughter attended a suburban school district while living in the city wants the criminal charges against them dismissed.
Hamlet and Olesia Garcia face theft of services and conspiracy to commit theft of services for allowing their daughter to remain in Lower Moreland School District while living in Philadelphia last school year.
The Garcias say they were separated and 5-year-old Fiorella was living with her grandfather in Huntingdon Valley when she started attending Pine Road Elementary School.
They say she continued to attend the school after her parents reconciled and she moved back in with them in Philadelphia with two months left in the school year.
Montgomery County prosecutors, however, say the Garcias had lived in Philadelphia since 2004 and the girl never resided in Lower Moreland.
