Court orders re-sentencing in Pa. campus spy case

    A Pennsylvania appeals court has ruled that a former university administrator who admitted spying on his DeSales University co-workers pumping breast milk or changing clothes must be re-sentenced.

    The three-judge Superior Court this week ordered a judge to re-sentence 34-year-old John Bednarik II and sent the case back to Lehigh County Court.

    Bednarik admitted filming one woman pumping breast milk and trying to watch or film three others changing clothes in a gymnasium locker room. He was sentenced nine to 21 months in prison after pleading guilty in Sept. 2012 to invasion of privacy charges.

    Bednarik appealed, claiming the judge imposed a sentence beyond the standard range because the incidents occurred at a Roman Catholic university. He was fired by the university.

    A hearing is scheduled for Oct. 10.
