Senator Scutari challenges proposed rules for medical marijuana law

Friday, October 15th, 2010

The primary sponsor of New Jersey’s medical marijuana law is challenging the way the Christie administration is implementing it.

Senator Nick Scutari says the strict rules proposed by the state Health Department do not comply with the intent of the law. Scutari is introducing a resolution in the legislature to invalidate the regulations and give the administration 30 days to amend or withdraw them.

“In my estimation they don’t want this to happen. They’re treating medical marijuana if it’s almost radioactive material. That somebody is going to get a hold of it and something is going to happen terribly.”

Scutari says the rules limit the potency and strains of the medical marijuana and provide for fewer growers and dispensaries than the law stipulated. He says the rules will make it too difficult for patients to get the drug. Scutari is hopeful he can reach a compromise to assure the program is effective.
