2nd Danieal Kelly related lawsuit has Nutter fuming

The latest lawsuit alleges that Philadelphia’s Department of Human Services is “an unsafe agency for children” and calls for a federal court to appoint an independent trustee to oversee reforms. It is filed on behalf of 28,000 children who have at one time been under DHS supervision. The attorney David Mildenberg is from the same law firm that earlier filed a lawsuit on behalf of the Danieal Kelly estate blaming DHS and others for her death.

The Daily News reports that Mayor Michael Nutter reacted angrily to news of the lawsuit calling it outrageous, and a disgrace. Nutter as well as many legal observers view the lawsuit as opportunistic in that it attempts to solely place blame on the city social services agency while in the case of Danieal Kelly a local Grand Jury investigation alleges that Kelly’s mother shares some responsibiilty for her death
